Privacy Policy

This Privacy Policy explains how the NovexGO app and novexgo.com.br website (together, “NovexGO”, “we”) process the personal data of their users (“you”, “data subject”), in accordance with Brazilian Law No. 13,709/2018 (General Personal Data Protection Law, “LGPD”), the Brazilian Internet Civil Rights Framework (Law No. 12,965/2014) and other applicable rules.

1. Data controller and contact channel

NovexGO is the controller of the personal data processed under this Policy. Privacy requests, including the exercise of rights and contact with the Data Protection Officer (DPO), should be sent to privacidade@novexgo.com.br.

2. Data we process

• Registration data: name, email address and access credentials.
• Location data: the device’s geographic position, used during navigation, track recording and the creation of reports.
• Content you create: tracks, saved points, layers, photos and road reports.
• Support data: messages, images and technical information you choose to send when reporting a problem or suggestion.
• Technical and security data: connection and usage information needed to operate the service, prevent fraud and comply with legal obligations.
• Launch list: the email address voluntarily provided on the website to receive the launch announcement.

3. Purposes and legal bases

• Providing the service (creating and maintaining accounts, navigating, syncing backups, displaying reports): performance of a contract (LGPD Article 7, V).
• Security and fraud prevention, account protection and service integrity: legitimate interest (Article 7, IX).
• Support and app improvements based on reports you submit: legitimate interest (Article 7, IX).
• Sending the launch announcement: consent (Article 7, I), which may be withdrawn at any time.
• Compliance with legal and regulatory obligations, including retention of access logs required by the Brazilian Internet Civil Rights Framework: legal obligation (Article 7, II).

4. Location

Location is processed primarily on the device itself. It is sent to our servers or partners only when necessary for a feature you request, such as calculating a route, searching for an address, publishing a report or backing up a track. You can revoke location permission in Android settings at any time, understanding that this prevents navigation.

5. Sharing

We do not sell or rent personal data or use it for advertising. We may share it only with:

• Processors and technology partners that provide cloud infrastructure, hosting, maps, satellite imagery, routing, address search and access statistics, always limited to what is necessary for each purpose and required to protect the data;
• Other users, solely concerning road reports you publish, without identifying your name;
• Public authorities, pursuant to a court order or lawful request.

6. International transfers

Some technology partners may store or process data outside Brazil. In those cases, we adopt the safeguards provided for in LGPD Article 33, such as contractual clauses and the selection of providers with adequate levels of protection.

7. Retention

We retain data for as long as necessary to fulfil this Policy’s purposes: account data and backups while the account is active; road reports while they remain valid; and other data for legally required periods or a reasonable time to resolve requests. Afterwards, the data is deleted or anonymised.

8. Security

We adopt appropriate technical and administrative measures to protect data against unauthorised access and accidental or unlawful destruction, loss, alteration or disclosure. No system is entirely immune to risks; keep your password confidential. If a security incident could cause significant risk or harm, we will notify data subjects and Brazil’s National Data Protection Authority (ANPD) as required by law.

9. Your rights

Under LGPD Article 18, you may request: confirmation of processing; access to data; correction of incomplete, inaccurate or outdated data; anonymisation, blocking or deletion of unnecessary or excessive data; portability; deletion of data processed on the basis of consent; information about sharing; and withdrawal of consent. You may also lodge a complaint with the ANPD.

You can delete your account and backup at any time in the app or on the Delete account. Other requests should be sent to privacidade@novexgo.com.br and will be answered within the statutory deadlines.

10. Cookies and website statistics

The website does not use advertising cookies. We use a cookie-free access statistics tool that presents only aggregate data without identifying visitors.

11. Children and adolescents

NovexGO is not intended for children under 13. If we identify data from minors without the consent required by law, it will be deleted.

12. Changes

This Policy may be updated. The current version will always be on this page, with its date at the top. Significant changes will be communicated in the app.

13. Governing law and jurisdiction

This Policy is governed by the laws of the Federative Republic of Brazil. The courts of the data subject’s place of residence are designated to resolve any disputes.
