Terms of Use and Responsibility

These Terms govern the use of the NovexGO app and novexgo.com.br website (together, “NovexGO”, “we”). By creating an account or using NovexGO, you (“user”) confirm that you have read, understood and fully accepted these Terms and the Privacy Policy. If you do not agree, do not use the service.

1. The service

NovexGO is an Android navigation app offering maps, route calculation, voice directions, track recording, user-shared reports and Android Auto integration. Some features require an internet connection.

2. Registration and account

• To use NovexGO, you must create an account with truthful, complete and up-to-date information.
• Accounts are personal and non-transferable. You are responsible for keeping your password confidential and for all activity carried out with it.
• Use is permitted for people aged 13 and over. Users under 18 must have permission from a parent or legal guardian.

3. Licence to use

We grant you a personal, limited, non-exclusive, non-transferable and revocable licence to use NovexGO on devices you own or control, solely for lawful purposes and in accordance with these Terms.

4. Road safety and driver responsibility

• NovexGO is a support tool. Driving is solely the driver’s responsibility. The driver must comply with the Brazilian Traffic Code, signs, traffic authorities and actual road conditions, which take precedence over any information in the app.
• Do not handle your phone while the vehicle is moving. Set your destination before leaving, use voice commands or Android Auto, or ask a passenger.
• Routes, street names, speed limits, speed cameras, traffic conditions and reports may be incomplete, outdated or incorrect. Always assess whether a suggested route is safe, permitted and suitable for your vehicle.

5. Third-party and user content

Maps, satellite imagery and routes rely on third-party and collaborative data, with no guarantee of accuracy, completeness or timeliness. Road reports are published by users and are not checked in advance by NovexGO.

6. User conduct

The following are prohibited:

• publishing false, offensive or discriminatory reports, or reports that put others at risk;
• attempting to access accounts, data or systems without authorisation, or bypassing security measures;
• using the service in an automated manner, overloading it or impairing its operation;
• copying, modifying, decompiling, reselling or commercially exploiting NovexGO without authorisation;
• using the service for any unlawful purpose.

Breaching these Terms may result in removal of content and suspension or deletion of the account, without prejudice to applicable legal measures.

7. Your content

You retain ownership of the tracks, saved points and photos you create. By publishing a road report, you authorise NovexGO to display it free of charge to other users while it remains valid.

8. Intellectual property

The NovexGO brand, name, logos, software, design and other elements are protected by intellectual property law and belong to NovexGO or its licensors. Third-party components are used under their respective licences.

9. Availability

We make reasonable efforts to keep NovexGO available and working correctly, but do not guarantee uninterrupted or error-free service. We may change, suspend or discontinue features at any time, with advance notice whenever possible. We recommend periodically exporting your tracks and saved points.

10. Limitation of liability

To the fullest extent permitted by applicable law, including the Brazilian Consumer Protection Code, NovexGO is not liable for damage arising from driving decisions; inaccurate maps, routes, limits, speed cameras or reports; connection, GPS or device failures; temporary unavailability; or use contrary to these Terms.

11. Termination

You may close your account at any time in the app or on the Delete account. We may close or suspend accounts that breach these Terms or the law.

12. Changes to these Terms

These Terms may be updated. The current version will always be on this page. Significant changes will be communicated in the app, and continued use after notification constitutes acceptance of the new version.

13. Governing law and jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. The courts of the user’s place of residence are designated to resolve any disputes.
